1. Introduction
Welcome to The Comp Collection, a dedicated marketplace for athletes to buy and sell pre-loved stagewear, including competition bikinis, themewear, and gowns. These Terms and Conditions govern your access to and use of The Comp Collection's services, including our website and other related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and all terms incorporated by reference. If you do not agree with these Terms, please refrain from using our platform.

2. Fees
Listing items on The Comp Collection is free. However, we charge a 15% commission on each successful sale. This fee covers payment processing, administration, and platform maintenance costs.

3. General Terms of Use
The Comp Collection operates as a peer-to-peer (P2P) platform, facilitating transactions between individuals in the competitive bodybuilding and performance community. We provide a unique space where members can find, list, and exchange high-quality stagewear for competitions, photoshoots, and related events.

4. Acceptance of Terms
By accessing our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use our Services. These Terms apply to all users of the Services, including buyers, sellers, and browsers.

5. Changes to Terms
The Comp Collection reserves the right to modify these Terms at any time. We will provide notice of any significant changes by posting the updated Terms on our website or through other communication methods. Your continued use of the Services after such changes will constitute your acknowledgment and agreement to the modified Terms.

6. Membership Eligibility
To use our Services, you must be at least 16 years old and capable of forming legally binding contracts under applicable law. If you are under 18, you may use our Services only with the involvement of a parent or guardian. By creating an account, you represent that you meet these criteria.

7. Account Registration and Security
When you register for an account with The Comp Collection, you agree to: (a) provide accurate and up-to-date information about yourself, (b) maintain the security of your password and account, and (c) be fully responsible for all activities under your account and any actions that occur through its use.

8. Use of Services
Our Services allow you to buy and sell competition-related attire. You agree to use our Services in compliance with all applicable laws, regulations, and these Terms. You must not use our Services for any illegal or unauthorised purposes.

9. Content and Listings
As a user, you may post content and listings on our Services. You are solely responsible for the content you post and warrant that you own or have the right to use and share such content.

10. Rights to Imagery

By listing items for sale or otherwise using The Comp Collection’s platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, modify, and share any images, descriptions, or content you provide. This includes the right to use your content across our website, social media platforms, marketing materials, and all promotional channels.

Once content is provided, you acknowledge and agree that The Comp Collection has the right to use it for these purposes without additional permissions or compensation.

You confirm that you have the necessary rights and permissions to upload and share this content and that it does not infringe on any third-party rights, including copyright or privacy. The Comp Collection will not be held responsible for unauthorised use of images or content by third parties outside of our platform.

11. Transactions and Payments
The Comp Collection facilitates transactions between users but is not a party to any agreements between buyers and sellers. While we may provide payment processing services, we are not responsible for the fulfillment of any transactions.

12. Prohibited Activities
You agree not to engage in the following activities: (a) violating any laws, third-party rights, or our policies, (b) using our Services if you are unable to form legally binding contracts, (c) posting false, inaccurate, misleading, defamatory, or offensive content, (d) distributing spam, chain letters, or pyramid schemes, (e) distributing viruses or harmful technology, (f) infringing upon others' intellectual property rights, (g) undermining the feedback or rating system.

13. Intellectual Property
All content on the Services, including text, graphics, logos, icons, images, and software, is the property of The Comp Collection or its content suppliers and is protected by UK and international copyright laws.

14. Disclaimers
The Comp Collection provides its Services on an "as is" and "as available" basis without any warranty or condition, express or implied. We do not guarantee and are not responsible for the accuracy, completeness, reliability, or timeliness of any content available through the Services.

15. Limitation of Liability
In no event shall The Comp Collection, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Services, (b) any conduct or content of any third party on the Services, (c) any content obtained from the Services, and (d) unauthorised access, use, or alteration of your transmissions or content.

16. Listing & Selling on The Comp Collection

  1. Listing Description
    Members of The Comp Collection can list and sell new and used stagewear, including competition bikinis, themewear, and gowns. All listings must adhere to our quality standards and fall within accepted categories. For a complete list of categories, please visit The Comp Collection.
    Counterfeit or inauthentic items are strictly prohibited. We do not permit listings that are unlawful, contain nudity or violence, or are offensive, abusive, bullying, threatening, harassing, obscene, misleading, untrue, defamatory, derogatory, or contain inappropriate language. The Comp Collection reserves the right to remove any listings that do not comply with these standards.

By listing an item for sale, you warrant that: (a) you comply with this Agreement,
(b) you have the legal right to sell the item,
(c) your item description, including any flaws, is accurate and truthful, and
(d) the item is categorised correctly.

  1. Binding Sale
    All sales on The Comp Collection are binding. Sellers must accurately list their items, and Buyers should carefully review the description before purchase. Sellers are required to fulfill orders promptly unless there are exceptional circumstances. Buyers must honour their purchase commitments unless prevented by exceptional circumstances. Non-compliance may result in account suspension.

  2. Fee Avoidance
    Prices must accurately represent the sale. Altering prices post-sale to avoid The Comp Collection's fees is prohibited. Engaging in off-platform transactions to bypass fees or the checkout process may result in account termination.

  3. Shipping Fees
    Sellers may manage their own shipping, adding reasonable fees to cover packaging and postage. We recommend using "Tracked" shipping for all items. Untracked items are sent at the Seller's risk and may not be supported in the event of disputes.

  4. Trade Information
    Upon sale completion, Sellers and The Comp Collection have access to the Buyer's postal address for the sole purpose of fulfilling the sale.

  5. Exclusivity
    If an item is listed on multiple platforms, priority is given to the Buyer who completes the purchase through The Comp Collection.

  6. Linking to Competitors
    Referring members to competing marketplaces is prohibited.

17. Buying on The Comp Collection
When purchasing an item, Buyers are responsible for reading the entire item description and acknowledge that they are entering a legally binding contract with the Seller. The Comp Collection facilitates these transactions but does not transfer legal ownership of items from Sellers to Buyers.

18. Seller Responsibilities and Payment Process

  1. Notification of Sale
    Once your item is sold, The Comp Collection will notify you by email. If we do not hear back from you within 7 days, we will automatically refund the buyer. Please respond to the email promptly and inform us when you will ship the item or if it has already been sent.

  2. Shipping Requirements
    Items must be shipped using a tracked and signed-for delivery service.

  3. Retention of Proof of Postage
    Sellers must keep the receipt and tracking details, as they are essential for any claims related to lost parcels.

  4. Providing Tracking Information
    Once the item is shipped, you must send the tracking details to The Comp Collection.

  5. Lost Parcels
    If the item is lost in transit, The Comp Collection will refund the buyer. The seller is responsible for making a claim with the courier and we are unable to transfer any funds to the seller.

  6. Tracking and Delivery Updates
    Sellers are responsible for monitoring their parcel and notifying The Comp Collection once the item has been safely delivered to the buyer.

  7. Confirmation of Delivery
    Once the buyer confirms receipt of the item, the seller must email The Comp Collection to confirm the item has been successfully delivered.

  8. Payment Issuance
    Payments will be issued one week after the buyer confirms receipt of the item and after the seller notifies The Comp Collection.

  9. Payment Methods
    Once the item is sold, the seller can choose between PayPal or bank transfer as their payment method. This will be provided upon listing the item. Please ensure your payment details are correct to avoid delays in payment.

19. Returns and Cancellations
We do not currently offer returns or cancellations unless the item is significantly not as described or in the event of an exceptional circumstance. Buyers are encouraged to carefully review item descriptions before purchasing.

20. Prohibited Content
All listings must comply with The Comp Collection’s content guidelines. The sale of counterfeit, stolen, or prohibited items is strictly prohibited. Listings must accurately describe the condition of the items, including any wear or damage.

21. Dispute Resolution
In the event of a dispute between a buyer and seller, The Comp Collection will attempt to mediate a fair resolution. We may intervene in cases of lost parcels, damaged goods, or inaccurate item descriptions. Buyers and sellers are encouraged to communicate directly to resolve issues, but The Comp Collection will provide support where necessary.

22. Governing Law
